1. Acceptance of Terms
Welcome to Crewable ("we," "our," "us," or the "Company"). These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Crewable governing your access to and use of our website, application, and services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Service.
We reserve the right to modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service. Your continued use after changes constitutes acceptance of the modified Terms.
2. Description of Service
Crewable is a race planning and crew coordination platform designed for ultra runners. The Service provides tools for:
- Creating and managing race plans with customizable details
- Planning aid station strategies and nutrition requirements
- Managing product catalogs (nutrition, hydration, gear)
- Uploading and visualizing GPX route files
- Coordinating with crew members and support teams
- Integrating with third-party services (Strava, Endurance HQ, etc.)
- Tracking race-day activities and logistics
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3. User Accounts and Registration
3.1 Account Creation
Your account may be created through one of the following methods:
- Direct Registration: You create an account directly on our website
- Event Registration Opt-In: You opt-in during event registration on a partner platform (e.g., Endurance HQ)
- Race Director Invitation: A race director invites participants to use our service. In this case, you will receive an invitation email and your account is created only after you click the activation link, constituting your consent to our Terms and Privacy Policy
To use certain features of the Service, you must:
- Provide accurate and complete information
- Be at least 13 years old (or 16 in the European Economic Area)
- Maintain the security and confidentiality of your account credentials
- Promptly update your account information if it changes
3.2 Account Security
You are responsible for:
- All activities that occur under your account
- Maintaining the confidentiality of your password
- Notifying us immediately of any unauthorized access or security breach
We are not liable for any loss or damage arising from your failure to protect your account credentials.
3.3 Account Termination
You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms or engage in prohibited activities. Upon termination, your right to use the Service ceases immediately, and we may delete your data in accordance with our Privacy Policy.
4. Subscription Plans and Billing
4.1 Subscription Tiers
We offer three subscription tiers with varying features and limits:
- Solo Runner ($9/month or $90/year): Up to 3 races, nutrition tracking, GPX import, basic aid station planning
- Crew Chief ($19/month or $190/year): Up to 10 races, crew coordination features, advanced analytics, race access sharing
- Race Director ($49/month or $490/year): Unlimited races, team management, priority support, advanced features
4.2 Billing and Payments
- Payment Processing: All payments are processed securely through Stripe. We do not store your full credit card information.
- Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless canceled.
- Price Changes: We may change subscription prices with 30 days' notice. Changes apply at your next renewal.
- Taxes: Prices do not include applicable taxes. You are responsible for all taxes.
- Failed Payments: If a payment fails, we may retry charging your payment method and may suspend your account until payment is resolved.
4.3 Cancellation and Refunds
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
- No Refunds: We do not provide refunds for partial subscription periods, except as required by law or at our sole discretion.
- Access After Cancellation: Upon cancellation, you will retain access until the end of your paid period. After that, your account will be downgraded to a free tier (if available) or access will be restricted.
4.4 Free Trials
We may offer free trials at our discretion. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Free trial eligibility is determined by us and may be limited to one per user.
5. User Content and License
5.1 Your Content
"User Content" means any data, information, text, images, files, or other materials you upload, submit, or store on the Service, including race plans, product catalogs, GPX files, aid station data, and profile information.
5.2 Ownership
You retain all ownership rights to your User Content. By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, store, transmit, and display your User Content solely to:
- Provide and operate the Service
- Improve and develop new features
- Comply with legal obligations
- Share with collaborators you designate (e.g., crew members)
5.3 Content Responsibility
You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not infringe third-party intellectual property rights
- Your User Content complies with these Terms and applicable laws
5.4 Content Removal
We reserve the right to remove any User Content that violates these Terms, infringes intellectual property rights, or is otherwise objectionable. We are not obligated to monitor User Content but may do so at our discretion.
6. Prohibited Uses
You agree NOT to use the Service to:
- Violate any local, state, national, or international law
- Infringe intellectual property rights of others
- Transmit viruses, malware, or other malicious code
- Harass, abuse, threaten, or intimidate others
- Impersonate any person or entity or misrepresent your affiliation
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to the Service or other users' accounts
- Scrape, crawl, or use automated tools to collect data from the Service
- Use the Service for any commercial purpose not authorized by us
- Reverse engineer, decompile, or disassemble any part of the Service
- Remove or modify any copyright, trademark, or proprietary notices
- Submit false, misleading, or fraudulent information
Violation of these prohibitions may result in immediate termination of your account and legal action.
7. Intellectual Property Rights
7.1 Our Rights
The Service and all materials, including software, text, graphics, logos, icons, images, audio clips, and trademarks, are the property of Crewable or its licensors and are protected by copyright, trademark, and other intellectual property laws.
7.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use, subject to these Terms.
7.3 Trademarks
"Crewable" and related logos are trademarks of Crewable. You may not use these trademarks without our prior written permission.

- Statement of good faith belief

8. Third-Party Services and Integrations
8.1 Third-Party Services
The Service integrates with third-party services including Clerk (authentication), Stripe (payments), SendGrid (email), Strava (activity tracking), Mapbox (maps), and Endurance HQ (event integration).
8.2 Third-Party Terms
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services or their practices.
8.3 Data Sharing
When you use integrations, we share necessary data with third parties as described in our Privacy Policy. You consent to this data sharing by using these integrations.
8.4 Third-Party Links
The Service may contain links to third-party websites (e.g., sponsor links). We are not responsible for the content, accuracy, or practices of linked websites.
9. Disclaimers and Limitations of Liability
9.1 Service Availability
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
9.2 No Warranty
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from using the Service will be accurate or reliable
- Any errors in the Service will be corrected
- The Service will meet your requirements
9.3 Race Planning Disclaimer
IMPORTANT: Crewable is a planning tool only. We do not provide medical, nutritional, or training advice. Consult qualified professionals before making decisions about nutrition, hydration, or race strategies. You are solely responsible for your safety during training and racing.
9.4 Limitation of Liability
To the maximum extent permitted by law, Crewable and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use or inability to use the Service
- Any unauthorized access to or use of our servers or your data
- Any interruption or cessation of the Service
- Any bugs, viruses, or malicious code transmitted through the Service
- Any errors or omissions in content or loss of content
- Any conduct or content of third parties
Our total liability to you for all claims arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
9.5 Jurisdictional Limitations
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
10. Indemnification
You agree to defend, indemnify, and hold harmless Crewable and its officers, directors, employees, contractors, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Any harm caused to other users through your use of the Service
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
11. Dispute Resolution and Governing Law
11.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of [Your State], without regard to its conflict of law provisions.

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
13. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
14. Entire Agreement
These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, constitute the entire agreement between you and Crewable regarding the Service and supersede all prior agreements and understandings.
15. Waiver
Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Crewable.
16. Assignment
You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last Updated" date
- Sending email notification for significant changes
Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree with the changes, you must stop using the Service and terminate your account.
18. Survival
The following sections shall survive termination of these Terms: User Content and License, Intellectual Property Rights, Disclaimers and Limitations of Liability, Indemnification, Dispute Resolution and Governing Law, and any other provisions that by their nature should survive.
